Islamabad: The Hon’ble Chief Justice of Pakistan Mr. Justice Iftikhar Muhammad Chaudhry took notice on an application of Zulfiqar Ali Mahar, President Sindh Paramedical Staff Welfare Association Ghulam Muhammad Mahar Medical College, Sukkur and others, stating therein that the Hon’ble Prime Minister of Pakistan had announced the one thousand rupees increase in the salaries of Daily Wages on the Labour day on 1st May 2010. But after issuing the notification one department is still refusing to pay the increased benefit to the employees showing lame excuses. Therefore, they requested the Hon’ble Chief Justice of Pakistan for justice.
Action was taken and report was called from the Principal, Ghulam Muhammad Mahar Medical College Sukkur (GMMMC) who stated that “immediately after receipt of this application, same was sent to the Registrar Shaheed Mohtarma Benazir Bhutto Medical University Larkana for further necessary action. The Registrar SMBBMU Larkana intimated that Notification No.L-II-13-4/78, dated 15.09.2010 issued by Labour Deptt. Govt. of Sindh applies to unskilled workers in all industrial/Commercial establishment undertaking of any sort (registered or unregistered) and does not apply to Universities. This college administration is unaware of any notification/orders issued or passed by the Hon’ble Supreme Court of Pakistan in this context; however any order passed will be complied with by the undersigned (Principal)”.
The office initiated the note that this Court has been pleased to pass an order dated 04.11.2010 in HRC No.16360/2009, 1859-S and 14292-P/2010 (Lady Health Workers Case) that Wage of Employees should be minimum as Rs.7000/- P.M. This judgment shall also be considered a guideline for all the executive departments in future while fixing the wages of the employees being engaged by the government organizations on contract basis or under any other programme funded by the government or any other agency.
After going through the report of Principal and note of office, the Hon’ble Chief Justice of Pakistan passed the order that “Copy of judgment/order be forwarded to the Secretary Health Sindh with direction to redress the grievance of applicants in the light of said judgment and submit compliance report within 15 days”
In compliance with the directions of the HCJP, that “The Principal, Ghulam Muhammad Mahar Medical College, Sukkur informed that the Vice Chancellor has accorded permission for increasing the salary of daily wages staff to minimum Rs.7000/- (seven thousand only) with effect from 01.06.2011”.
After going through the report, the Hon’ble Chief Justice of Pakistan has been pleased to order to file the instant application as relief has been provided to the applicants and their grievance has been addressed.
